TRAINING SERVICES AGREEMENT AND UNDERSTANDING

Training Services

HCK9 agrees to provide dog training services to the Owner's dog ("Dog") in accordance with the selected training program. These services may include, but are not limited to, obedience training, behavior modification, socialization, and other relevant aspects of dog training.

Owner's Obligations

The Owner acknowledges and agrees that the effectiveness of the training services provided by HCK9 is dependent upon the Owner's active involvement and commitment to maintaining and reinforcing the training techniques and lessons taught by HCK9. The Owner agrees to follow any instructions, recommendations, or guidelines provided by HCK9 in order to achieve the desired results of the training services.

Non-Refundable Fees

The Owner understands and agrees that the fees paid for the training services are non-refundable due to the boarding space and trainer time having been utilized during the course of the training. The Owner acknowledges that HCK9 has allocated resources, including but not limited to trainer time, boarding facilities, and training equipment, to provide the services agreed upon in this Agreement. Additionally, the Owner acknowledges they have been informed of follow up Home Sessions at no charge, if applicable, with certain training packages.

No Guarantees

The Owner acknowledges that, due to the unique nature of each dog and the various factors that may influence the success of the training services, HCK9 cannot guarantee specific results or outcomes. The Owner further understands that the ultimate success of the training program depends on the Owner's commitment to maintaining and reinforcing the training techniques and lessons taught by HCK9. Further, The Owner understands that failure to participate in training debrief at pickup, if applicable, will void any provided Home Sessions.

Indemnification

The Owner agrees to indemnify, defend, and hold harmless HCK9 and its employees, agents, and representatives from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Dog's participation in the training services, except to the extent caused by HCK9's negligence or willful misconduct.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflicts of law principles.

BOARDING SERVICES AGREEMENT

1. Boarding Services: Hurricane Creek K9 LLC provides professional dog boarding services that prioritize the safety, comfort, and well-being of your furry friend. Our boarding facilities are designed to create a home-like environment for your dog, ensuring a stress-free and enjoyable experience while you're away.

At HCK9, we understand that every dog is unique, with varying needs and personalities. That's why we offer personalized care and attention to each dog in our care. Our experienced and dedicated staff will make sure your dog is comfortable, well-fed, and has plenty of exercise and playtime.

We reserve the right to alter the boarding arrangements for the best interest of the dog. This means that in the event of an emergency or unforeseen circumstance, we may need to modify the boarding arrangements to ensure your dog's safety and well-being. We will make every effort to communicate any changes with you and to accommodate your preferences whenever possible.

You can rest assured that your dog is in good hands at HCK9. We take the responsibility of caring for your pet seriously and are committed to providing a safe and comfortable environment.

1. Late Charges.

a. A charge of $15.00 will be assessed for being between 15 and 30 minutes late for pickup. d. A charge of $1.00 per minute will be assessed for being more than 30 minutes late for pickup.

2. Release of Liability: Owner acknowledges that HCK9 will take reasonable care of the Dog while in its custody. However, Owner understands and agrees that HCK9 shall not be liable for any harm or injury to the Dog, including but not limited to injury or illness, unless such harm or injury is a direct result of HCK9's gross negligence or willful misconduct.

3. Hold Harmless: Owner agrees to hold harmless and indemnify HCK9, its owners, employees, and agents from any and all claims, damages, costs, and expenses, including attorney's fees, arising from or related to Owner's use of HCK9's facilities, including but not limited to any injury or harm to Owner, Owner's guests, or the Dog(s).

4. Emergency Care: In the event of a medical emergency, HCK9 shall make reasonable attempts to contact Owner or Owner's designated emergency contact. However, if HCK9 is unable to contact Owner or Owner's designated emergency contact, HCK9 is authorized to obtain medical treatment for the Dog(s) at Owner's expense.

5. Miscellaneous:

a. This Agreement represents the entire understanding between the parties and

supersedes all prior negotiations, understandings, and agreements between the

parties.

b. This Agreement shall be binding upon and inure to the benefit of the parties and their respective heirs, successors, and assigns.

c. This Agreement shall be governed by and construed in accordance with the laws of the state of Georgia, without giving effect to its conflicts of laws principles.

d. Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

e. This Agreement may not be modified except in writing signed by both parties.

Owner acknowledges that he or she has read and understood this Agreement and agrees to be bound by its terms.

Dog Bite Liability and Reimbursement Clause:

In the event that any dog, while under the care or supervision of Hurricane Creek K9 LLC ("the Company"), causes injury by biting or attacking any staff member or representative of the Company, the owner of the dog ("the Owner") hereby agrees to assume full and sole responsibility for any and all costs associated with such injury, including, but not limited to, medical treatment, lost wages, and other damages directly or indirectly resulting from the incident.

The Owner further agrees to indemnify, defend, and hold harmless the Company, its staff members, representatives, and agents from any and all claims, actions, suits, judgments, and demands arising out of or in connection with the injury caused by the dog, including, but not limited to, all medical costs, legal fees, and other expenses incurred as a result of the injury.

In the event of a dog bite or attack causing injury, the Owner shall promptly reimburse HCK9 for all costs and expenses incurred, as well as compensate the injured party for any damages, as required by this clause. The Owner's liability for reimbursement under this clause shall not be limited by any insurance coverage held by the Owner or HCK9.

Owner acknowledges their understanding and acceptance of the terms and conditions set forth in this Dog Bite Liability and Reimbursement Clause, and agrees to be legally bound by them.
